Terms & Conditions Last updated June 16, 2020. 1.0 By registering or using the services or products of PHONE FREEDOM or any of the service or products of PHONE FREEDOM JAMAICA LTD. or its affiliates (hereinafter referred to interchangeably as " PHONE FREEDOM JAMAICA ", "Phone Freedom", " PHONE FREEDOM ", our, or " we "), you agree to be subject to the the following Terms and Conditions of Service (hereinafter referred to as the "Terms" or the "contract"). 1.1 Please note that the Terms form a binding contract between you (hereinafter referred to interchangeably as " Customer ", " user ", or " you ") and Phone Freedom, and apply when using, any products or services distributed by Phone Freedom, as defined later in this document. If you are accepting these Terms on behalf of or representing a person or entity, you are binding the person or entity to the framework set forth in these Terms and you represent and warrant that you have sufficient power and authority to accept and enforce these Terms. Phone Freedom may periodically modify these terms as stipulated in Section 1.9 (Modification of Terms) of this contract. PLEASE READ THESE TERMS CAREFULLY TO MAKE SURE YOU UNDERSTAND EACH SECTION. Your account. 1.2 You must be at least 18 years of age to purchase products or use our services, as defined below. Buying our products or using our services requires that you create an account and register an email address and password. You are solely responsible for any and all actions taken using said account, and you must keep your password secure. 1.3 The product. The term "Product" refers to: a range of electronics, accessories and functions related to business administration and online stores, including the creation of invoices, orders, expense records, inventory control, and related reports. 1.4 Customer compensation. Customer will indemnify, defend and hold PHONE FREEDOM (its affiliates, employees, agents, executives and directors) harmless against all damages, liabilities, costs, and expenses (including reasonable attorney's fees) that result or arise from a claim by the Customer for current or alleged breaches of these Terms, negligent acts or omissions, breaches of applicable laws, rules, regulations, among others. 1.5 Aggregated / Anonymous Data. In addition to your other prior rights, PHONE FREEDOM may collect customer data with other data so that the results are not personally identifiable, and may collect anonymous technical data and other data on Customer's use of its website ("Aggregated / Anonymous Data"). PHONE FREEDOM will own this anonymous data and may use it for marketing, reporting, and other legal business purposes. 1.6 Disclosure of Information. PHONE FREEDOM may share the Data when in good faith it considers that the access, use, preservation or disclosure of said information is reasonably necessary to: (i) satisfy any applicable law, legal process or governmental request; (ii) enforce these Terms, including potential investigations of violations; or (iii) protect against imminent damage to our products and services, the rights, security of PHONE FREEDOM, its users or the public as required or permitted by applicable regulations. 1.7 To the fullest legal scope there is no guarantee that the website will be error-free, access will be continuous or uninterrupted, that the information provided or used with the product will be secure, accurate, complete, timely, or that any Customer Information will be preserved or maintained without loss. To the maximum extent of the law, Phone Freedom will not be responsible for any failure or other problems that arise from the use of the internet. 1.8 Liability Limitations. To the maximum extent permitted by law, in no event shall Phone Freedom be liable to you or any third party (i) for any loss of use, loss of data, business interruption, failure of security mechanisms, or any punitive, special, incidental, indirect or other damages. 1.9 Modification to the Terms. PHONE FREEDOM may modify these terms (including product and service prices) periodically, by posting the amended and updated Terms and Conditions on Phone Freedom website, available at https://phone-freedom.com/page/news-and-updates/. Continued use of our website after modifications constitutes your acceptance of the modifications. 2.0 Jurisdiction and Applicable Law, Arbitration. The country selected at the time of registration determines with which Phone Freedom entity will enter into this contract. For this Agreement, “reside” or “reside in” means the country of domicile of your person or the company you represent. In the event that you reside outside of Jamaica, your contract will be entered into with PHONE FREEDOM JAMAICA LTD. 2.1 This Contract will be governed at all points by the laws in force in Jamaica. Any controversy derived from this Contract, its existence, validity, interpretation, scope or compliance, will be submitted to the competent courts in Jamaica. General . 2.2 These Terms constitute the complete terms related to our products and services. If any of the provisions of this Contract should be declared null and void by a competent judge, the remaining provisions, however, will remain in full force and effect. PHONE FREEDOM and the Client agree to renegotiate any term that is declared void. 2.3 Assignment: You cannot assign or transfer this agreement, or any (or any) of the right (s) in this contract, and any attempt to transfer or assign it will be invalid. This Agreement may be assigned by PHONE FREEDOM at its discretion, without the consent of the Client / User. 2.4 No Waiver: No waiver of rights under this Agreement or any PHONE FREEDOM policy, or a Contract between Customer and PHONE FREEDOM shall constitute a subsequent waiver of this or any other right under this Agreement. 2.5 Contact information: If you have any questions, complaints or claims related to our products and services, please contact: PHONE FREEDOM, Email: info@phonefreedomjamaica.com. 2.6 Notifications: We may send you notifications by the email you register with on PHONE FREEDOM. All notification is effective from delivery. 2.7 Major Force: Neither party will be responsible for any delay or failure in performance due to events beyond the reasonable control of the defaulting party, including, without limitation, acts of God, earthquakes, labor conflicts, shortages of supplies, riots, war, fire, epidemics, pandemics, lack of telecommunications operators, or delays of public transport companies or other circumstances beyond their reasonable control. The excused party's obligations and rights will extend on a day-to-day basis for the period of time equal to the period of the excusable delay. Warranty: 2.8 A 10% RESTOCKING FEE will be charged on all items returned within 7 DAYS of purchase that do not have a manufacturer fault, 100% functional/working and meet requirement 2.9. Returns after this period will not be accepted (Sundays and public holidays are excluded). The customer is responsible for return shipping and re-shipping. 2.9 All item(s) returned MUST be in their original packaging. For those that are not packaged, their adhesive and plastic protections must be in place. 3.0 Please check and ensure you are purchasing exactly what you want. If you are not sure, please contact us (https://phone-freedom.com/page/contact-us/) for assistance before proceeding. 3.1 There is no warranty on liquid damaged devices that have been repaired. All other repairs carry a ONE MONTH/30 DAYS ONLY warranty, unless otherwise stated. 3.2 All jobs require a mandatory checking/assessment fee of a minimum of J$500 which is Non-Refundable. However, if your device can be repaired, it will go towards covering the repair cost. 3.3 All jobs left over thirty (30) days will attract a J$100 storage fee per day up to 120 days. Failure to collect your item(s) within this period of one hundred and twenty days would confirm your forfeiture of your item(s), which will now become the property of Phone Freedom Jamaica Limited. At this point we will decide what course of action to take with regards to the forfeited item(s) in recovering our losses and honouring our monthly obligations. 3.4 Our one month warranty policy is as follows: This warranty covers manufacturer faults only. Our warranty does not cover: Scratches, Burns, Misuse, Improper Handling, Abuse, Accident, Alteration, Neglect, Act of Nature, Unauthorized Repair or Installation. 3.4 Finally, once the client has registered on Phone Freedom to purchase products, services or both products and services, the client upon his/her registration clearly accepts and completely agree to everything in this Terms and Conditions document.
